Terms of Service

1. Acceptance

By using LensUp AI — in the mobile app (iOS and Android) or web version — you accept these Terms of Service and the Privacy Policy in full. If you do not accept these conditions, you must stop using the service immediately. The service is restricted to persons aged 16 or over.

2. Service description

LensUp AI is an application that generates professional headshots using artificial intelligence from a selfie provided by the user, using Google Vertex AI (Gemini). The selfie is processed in memory and never stored on LensUp AI servers. Generated headshots are transmitted directly to the user's device and automatically saved to Gallery (Android) or Photos (iOS). LensUp AI never retains users' images.

4. Watermark and AI disclosure

All generated images contain: (a) a visible 'Made with LensUp AI' watermark, removable for users who have made at least one purchase; (b) an invisible SynthID watermark (Google technology), which is never removable. Every generated image is identifiable as AI-generated content pursuant to Art. 50 of the EU AI Act. LensUp AI does not guarantee the suitability of generated images for contexts requiring documented photographic authenticity (e.g. identity documents, legal proceedings).

7. Intellectual property

Headshots generated by LensUp AI based on photos provided by the user are the exclusive property of the requesting user, to the extent that such photos are legitimately owned by them. LensUp AI claims no intellectual property rights over generated images. The LensUp AI name, logo, brand, prompts and service architecture are the exclusive property of the controller.

8. Limitation of liability

LensUp AI is provided 'as is' and 'as available'. The controller does not guarantee specific results in terms of quality, likeness or fitness for purpose. LensUp AI's maximum liability for any claim is limited to the amount actually paid by the user for the shots subject to the specific dispute.

9. Governing law and jurisdiction

These Terms are governed by Italian law. Any dispute arising from the interpretation, validity or performance of these Terms shall be subject to the exclusive jurisdiction of the Court of Pescara, Italy.
